Regular Meeting of the Land Use & Zoning Advisory Committee for the Town of Lakewood May 13, 2002 6:00 p.m.
Chairperson Gigi Bartels called to order the regular meeting of the Land Use & Zoning Advisory Committee for the Town of Lakewood at 6:00 p.m. on May 13, 2002. Present were Chairman Gigi Bartels, Secretary Marlene Sauriol, Town Advisor Lee Spletter, Ted Schuurmans, Raoul Schottky and Greg Weyers. A motion was made by Raoul Schottky and seconded by Ted Schuurmans to approve the agenda. Motion was carried. A motion was made by Lee Spletter and seconded by Ted Schuurmans to approve the minutes of April 9, 2002. Secretary Marlene Sauriol requested a clarification of the 150 square foot requirement on building as noted in the minutes of April 9, 2002. It was outlined that one parking space is required for every 150 square feet of retail space. With this added notation for the minutes, the motion was carried.
Robert Prasser was present regarding an application for a conditional use permit for a portable saw mill he needs in order to build his log home on County F. Gigi Bartels noted that a two-year time frame is allowed for such zoning in rural residential for portable sawmills. Melinda Obey and numerous neighbors of Robert Prasser were also present with objections to the conditional use permit. A letter from Mr. Van Ess regarding an objection was also presented. A petition with approximately 50 signatures was presented to the committee with objections to the conditional use permit. There was heated objection as to the noise, the fumes, the mess and a question was raised as to the hours, days and length of time when Mr. Prasser would be using the saw mill. Melinda Obey had paperwork substantiating Mr. Prasser's history of expired building permits and other county violations which were still outstanding. She noted there was a camper on the property which had not been removed. These violations were presented as a matter of history on how the petitioners felt Mr. Prasser would follow through on his upkeep of the portable saw mill and its usage. A lengthy heated discussion was held between the applicant and the petitioners present.
A motion was made by Raoul Schottky and seconded by Greg Weyers to recommend restrictions on the conditional use permit to include daytime use only from 12:00 p.m. to 6:00 p.m. for a period of one year and to review the overall permit as to neatness and tidiness of the property after the year to include another year to a maximum of two years total. Robert Prasser had no objection to operating the saw mill on this restricted basis. Again, discussion was held by the petitioners and the applicant and an amendment to the motion was made by Greg Weyers and seconded by Raoul Schottky to restrict usage on Tuesday, Wednesday and Thursday only of the week from 12:00 p.m. to 6:00 p.m. for Mr. Prasser's personal use only for a period of one year. If he has not finished his job in that year, then the conditional use permit will be reviewed for a maximum of one more year, not to exceed a total of two years. The property must be kept in a tidy and neat manner, such condition to be reviewed by the county zoning officials. Whenever the applicant has finished the cutting of his logs even if it is before the one year period or the maximum two year period, the portable saw mill must be removed. The sawmill cannot remain on the property after the job has been completed. Motion was carried. Secretary Marlene Sauriol is to write a letter to the Town recommending such restrictions. The committee reminded the petitioners to attend the county conditional use hearing when it is scheduled so that the concerns could also be addressed at that time.
Under Old Business, Raoul Schottky noted he had attended the conditional use permit hearing for Fivestar Fireworks with the Oconto County Board of Adjustment. He did not feel that the committee's recommendations were considered as recommended. The letter from Secretary Marlene Sauriol was read at the hearing, but no action was taken in regard to the restrictions recommended, nor were they individually evaluated and discussed. He wondered why we are even required to submit any recommendations if the county officials do not address the concerns of the committee. Such information is noted as part of the minutes herein and the committee will continue to input their recommendations as per individual applicants and hearings on conditional use permits for the county.
Ted Schuurmans reported on what is defined a "semi-trailer." He introduced a copy of the Wisconsin Statutes regarding the terminology, a copy of which is attached hereto as part of the minutes. Fifth wheels are not included in these Wisconsin Statutes.
Ted Schuurmans reported on the progress made by the Town Board and Tom Gryboski relative to obtaining the McDonald parking lot in Lakewood. This project is still in the negotiating process. A request was made of Town Advisor Lee Spletter to inquire of the Town Board at their meeting as to what is going on with the parking lot acquisition or condemnation. Ted Schuurmans reported that he had talked with Robert E. Lee considering the elements of Smart Growth and that they would try to have the information to him for the May meeting, but realistically, probably would not have anything to report until the June meeting.
Ted Schuurmans had talked to Lois Fisher regarding Sue Rapp, Chairman for the Town of Townsend, and their progress as to a Comprehensive Master Plan. They are not doing anything as yet, and they know that they are the only township not doing anything as yet. No further information was available at this time.
Under New Business, Greg Weyers and Lakewood Motorsports is considering adding a line of motorcycles to their sales. He needs the town to sign paperwork indicating he is in good standing as far as zoning and permits relating to his business. Discussion was held concerning this request. A motion was made by Ted Schuurmans and seconded by Raoul Schottky to recommend that the town board sign said said paperwork. Motion was carried. Greg Weyers will submit paperwork at the town board meeting.
Town Advisor Lee Spletter noted that Waubee Lake Association is discussing putting in a well to maintain the lake level. They will need to get the permits from the DNR. Two lakes in Oconto County have gone that route, namely, Rost Lake and Ranch Lake, with no noticeable results to date. Waubee Lake is approximately 18" to 2' down on levels. The committee discussed the issues and will be kept advised as to the results of this process.
There was no other business. A motion was made by Greg Weyers and seconded by Ted Schuurmans to adjourn at 7:20 p.m. Motion was carried.
