Minutes of the Regular Meeting of The Town of Lakewood Plan Commission Town of Lakewood October 10, 2005
In attendance: Adriane Bartels, Scott VanLaanen, Ted Schuurmans Greg Weyers, Raoul Schottky, and Lee Spletter. Excused: - Guests: See 10/10/05 Attendance sheet.
1. Call to Order: Chairperson Greg Weyers called the meeting order at 6:00 pm
2. Approval of Agenda: . Motion to approve the agenda with the additions of the as printed and the addition of Tony Kerscher to Old Business 6a. for a revisit to a conditional use permit from a previous meeting to move a 15-year-old building by, seconded by Ted Schuurmans and seconded by Scott VanLaanen, motion passed.
3. Approve Minutes of Prior Meeting: Raoul Schottky moved to accept the minutes of the September 12, 2005 meeting, seconded by Ted Schuurmans, motion passed. 4. Rezone, Conditional Use & Certified Survey Map/Plat Proposals:
Lovey Barbier Conditional Uses Permit for RV Park. James Morrison, Town of Lakewood Attorney explained the motion needed to reopen the RV Park Conditional use permit and what/why of what had to be done regarding it. A motion by Greg Weyers to revisit the original Condition Use Permit of Barbier/ Paul for a RV Park, seconded by Ted Schuurmans and the motion was passed. Barbier/Paul Lawyer was introduced and a discussion regarding Ted Schuurmans involvement with the Wheeler Lake Association as to his ability to being partial to the issue of the RV Park. It was stated the Ted was President, but he stated that he was a board member. Barbier/Paul Lawyer then questioned if Ted could be impartial and should not sit on the Plan Commission due to his association as a board member of the Wheeler Lake Association. James Morrison then answered in defense of Ted Schuurmans ability to serve on the Commission regarding this issue. Scott VanLaanen then questioned what position did Ted Schuurmans hold on the Wheeler Lake Association and was told that he was a Board member and asked if Ted could make an impartial decision on the issue and Ted stated that he could. Greg Weyers explained what the issue of discussion was about regarding the RV Park. Lee Spletter pointed out that the RV Park does not fit into the Comprehensive Plan for the Town of Lakewood or does the Rezone from Forestry to Parks. Barbier/Paul�s Lawyer then stated that the issue was not a rezone but a Conditional Use Permit and explained the definitions regarding the Conditional Use Permit in the County Zoning Regulations. He then how they would like to work with the Town of Lakewood and the Plan Commission for the requested Conditional Use Permit. He then explained the park use, layout, site maps, and what the Park would be like. He had a Park Informational sheet and drawing that was passed out. Question from Joan Grady about the traffic in and out of the Park and what it would be like on Highway F if it was approve, with some concern about traffic congestion and highway F�s condition and curves. Question from one attendant as to the amount of residents that would be present in the Park and was answered as unknown that they don�t know due to the type of residents and could possibly at 70% occupancy. It was explained that the conditions of the Conditional Use Permit would stay with the permit and would stay with the property if it was sold at some time in the future. Question regarding taxes, what does this do to the tax rate (are the units taxed by the Town) does it increase the value of the town, and what is the drain on the local taxes and use of services in the town? Most of this question could not be answered at this time. Barbier/Paul�s Lawyer asked to explain conditions that they would like to be added to the Conditional Use Permit to help solve some of the possible problems. (They had a list of these, but we did not receive a copy of them.) There were many that could also be added to follow Administrative Code, State Code and County and local Codes. Ted Schuurmans stated that the County Zoning states that campgrounds are not allowed in Forestry, only Temporary Camping, and he also questioned the definition of what temporary camping was. There was a question about what the lot sizes were going to be and if they were up to the Zoning Code. Joan White presented a letter from Lawyer Gerardo Gonzalez explaining the definitions of temporary camping and other item on this issue. DNR definitions are not the same as the County definitions, but the County establishes the legal definitions and this is what we should consider in making a decision. James Morrison explained much of the process that we should go thru and explained that in his opinion that this is not a true definition of Temporary Camping. Greg Weyers asked for a motion on the Conditional Use Permit for Pine Haven RV Park. After many wording of the motion it was asked of James Morrison as to how it should be worded and his suggestion was that a Conditional Use Permit application for Pine Haven RV Park be granted subject to such conditions as are adopted by the Plan Commission at a special meeting called for that purpose on October 25, 2005 at 6:00PM at the Lakewood Town Hall. The motion was made to recommend that the Lakewood Town Board approve a Conditional Use Permit application for Pine Haven RV Park be granted subject to such conditions as are adopted by the Plan Commission at a special meeting called for that purpose on October 25, 2005 at 6:00PM at the Lakewood Town Hall by Adriane Bartels and seconded by Scott VanLaanen. The motion was carried with one no vote by Ted Schuurmans. A public meeting was set for on October 25th at 6:00PM to what conditions are to be placed on the Conditional Use Permit. The Plan Commission has to decide what conditions are to be placed on it, but the public, committee and the owners have to agree on the conditions.
4b. Helen Kerscher, Rezone and preliminary Certified Survey Map. Rezone and Map were presented by Paul Shallow and explained to the committee. Motion by Adriane Bartels and second by Ted Schuurmans to recommend to the Town Board to approve the rezone from Forestry to Rural residency for the property, motion was carried. A motion by Ted Schuurmans and seconded by Greg Weyers to recommend the approval of the Preliminary Certified Survey Map to the Town Board, motion was carried.
4c. John and Peggy Kruczek, rezone from R1 to General Commercial. This property is in/near the commercial property in Lakewood and fits into the comprehensive plan for Lakewood. A motion by Ted Schuurmans and seconded by Scott VanLaanen to recommend to the Town Board to approve the rezone from R1 to General Commercial, motion was carried with Adriane Bartels abstaining.
4 d. Dave Grybowski, Conditional Use Permit to convert home to Duplex Unit. Discussion on the property and a motion was made by Ted Schuurmans and seconded by Adriane Bartels to recommend to the Town Board to approve the Conditional Use Permit, motion carried.
6 a. All Old Business Authorized by Law: a. Tony Kerscher, revisit Conditional Use Permit to move 15-year-old building. Tony Kerscher would like to move a building from Wheeler Lake Resort property to his property at 17890 North Road and it would require a Conditional Use Permit. A motion by Ted Schuurmans and seconded by Raoul Schottky to recommend that the Town Board approve the Conditional Use Permit and was approved. 5. All Other Business Authorized by Law: a. Set date for Informational Hearing on Storm Sewer Management. Motion by Ted Schuurmans and seconded by Scott VanLaanen to set the hearing for 5:00PM on October 25, 2005 at the Lakewood Town Hall and the town to advertise the hearing. Motion was carried.
6. Adjourn: Ted Schuurmans made a motion to adjourn the meeting, seconded by Adriane Bartels, motion carried at 7:48 PM.
