Minutes of the Regular Meeting of The Town of Lakewood Plan Commission Town of Lakewood June 12, 2006
In attendance: Scott VanLaanen, Ted Schuurmans, Greg Weyers, Raoul Schottky.
Excused: Adriane Bartels and Lee Spletter.
Guests: John Suminski, Ann Hogan, Rusty Billings
1. Call to Order: Chairperson Greg Weyers called the meeting order at 6:00 pm
2. Approval of Agenda: Motion to approve the agenda as presented by Ted Schuurmans, seconded by Scott VanLaanen, motion passed.
3. Approve Minutes of Prior Meeting: Ted Schuurmans moved to accept the minutes of the May 8, 2006 meeting, seconded by Scott VanLaanen, motion passed. 4. Rezone, Conditional Use & CSM/Plat Proposals:
1. 5. A. Ann Hogan, representative from the Nicolet Clinic, presented the future plans for the clinic and the proposed purchase of properties that they would like to purchase and develop. There is an access road abutting parcels #019-423210423 J & K that they would like to have vacated as they would own the property on both sides of the easement. There should be no problem with this. A motion by Ted Schuurmans and seconded by Raoul Schottky to recommend to the Town of Lakewood to accept this vacation of this right of way. Motion was carried.
2. 4. A. Discussion one rezone of parcels #019-423210423 J & K from Residential to Commercial. It was determined that it would be better for the Clinic to have it zoned to Community Services, and was accepted by the Clinic to change to this. Motion by Raoul Schottky, seconded by Ted Schuurmans to recommend to the Town of Lakewood to approve the rezone from Residential to Community Service. Motion was approved.
3. 4. B, Rusty Billings for a Conditional Use Permit to disturb 10,000 sq. ft. or more in Brookside Hill Development. Discussion on this was held and it is an after the fact issue that has been inspected by the County and the DNR with fines issued to the developer. A motion by Ted Schuurmans and seconded by Scott VanLaanen to recommend to the Town of Lakewood to approve the Conditional Use Permit for Rusty Billings. Motion was carried.
4. 4. C. Casey Swanson appeared for James Werner for a Certified Survey Map for the division of parcel #019-372708243 into 4 lots. Discussion was held on this division of this property and was acceptable except there was a question regarding the set back of the present septic system that would be partially in North Thielke Road right of way if there was a 33� road dedication on this Certified Survey Map. Would there be a liability to the Town as the map was presented? Motion was made by Ted Schuurmans and seconded by Raoul Schottky that we recommend the approval of the Certified Survey Map with the dedication of the 33� right of way and that the Town would not be liable for damage to or caused by the septic system on the right of way. Motion was carried.
5. 4. D. No person showed up for the Waubee Lodge Conditional Use Permit, tabled until next meeting if needed.
6. 4. E. John Suminski requested a Rezone of parcels 019-392907244 K & 019-392904943H1A from Rural Residential to Residential Single Family. There was discussion on this request and it fits into the Comprehensive Plan, so a motion was made by Ted Schuurmans and seconded by Scott VanLaanen to recommend to the Town of Lakewood to accept the rezone of these properties. Motion was carried.
5. All New Business Authorized by Law: 5.B. Extension of Long Street from Pleasant Hill to Redinger Lane. It was discovered that that part of Long Street was never vacated and that the town should develop it in the future. It (the extension of Long Street) will be added to the Lakewood Area Development Plan.
5.C. Looked at plans (2 plans) and discussed the parking lot between County F and Gage Street (new). Plan 1 was angle parking and plan 2 was perpendicular parking in the lot. After discussion, there was a motion by Greg Weyers and seconded by Ted Schuurmans that we recommend Plan 2 (perpendicular parking) to the Town of Lakewood. Motion was carried.
6. All Old Business Authorized by Law: 6.A. Discussion on the Small Lakes Ordinance for the Town of Lakewood was held and a motion was made by Greg Weyers and seconded by Ted Schuurmans that the Committee recommends to the Town of Lakewood that a change in the Ordinance be made that this would apply to lots abutting the lakes and they would be a minimum of 3 acres and have a minimum width of 300 feet. Motion was carried, and Ted Schuurmans will send the Town a copy of our version of the Ordinance that we approved.
6.B. Discussion was held on the Whitetail Acres II Subdivision that was done by Nerenhausen Surveyors. A Motion was made by Raoul Schottky and seconded by Ted Schuurmans that the Town of Lakewood send a letter requesting that Nerenhausen Surveyors attend the Plan Committee and Town Meetings to explain why the Whitetail Acres II Certified Survey Map was not presented to the Committee and Town of Lakewood before it was submitted to the County for approval, with the Town of Lakewood and the Plan Commission signing the letter. Motion was carried. 7. All Other Business Authorized by Law: 7.A. Procedures for Lakewood Planning Commissions Forms were discussed. The Request to be placed on the Agenda needs to have a place to check for Certified Survey Maps. On the Agenda, there should be added on the bottom, Subject To Change Until 24 Hours Before Meeting. Other discussion regarding our forms and publicizing them, we would hope that the Town of Lakewood would soon have a web site so that this information could be put out for information on the web.
7.B. Tabled until later in meeting.
7.C. Discussion on the Town of Lakewood plan for road ditch construction. Ted made a motion and was seconded by Greg Weyers that the Town should be informed and changes be made that there is an error in the Lakewood Storm water Management Plan in 3-1 page 3 � 4 that states the ditch depth should be a 30� maximum, this should be 30� minimum. Motion was carried.
7.D. Lakewood Land Development representative did not show up.
7.B. Re- opened. Discussion on the property located at 17174 St. Marys Road is being flooded during/after a heavy rain or run off. All the water from the surrounding area (BP Gas Station, Motel, Motor Sports, Ace Hardware, Storage units, basically all the area on both sides of St. Marys Road between County �F� and Highway 32) are draining thru this property into small pipes that exits this property. Figure 6-2 in the Storm water Plan shows a possible relief to this problem. Another alternative could be the use of a pump station in this area. There are many areas in the area covered by the Storm water Plan that are having problems. A motion by Raoul Schottky and seconded by Scott VanLaanen to recommend that the Town look at the problem and take action to alleviate the problem in that area. Motion was carried with Greg Weyers abstaining.
8. Adjourn: Ted Schuurmans made a motion to adjourn the meeting, second by Scott VanLaanen, motion carried at 8:36 PM.
