REGULAR TOWN BOARD MEETING
January14, 2013
7:30 p.m.
LAKEWOOD ADMINISTRATIVE OFFICE

This meeting was posted in the four usual places those being the Lakewood Town Hall, Lakewood Super Valu, Laona Bank and Lakewood Administrative Office.

PRESENT: Joanne Roy, Chairman, Lee Spletter, Supervisor, Tom Haberstein, Supervisor Denise Jackett, Clerk, Virginia Nelson, Treasurer.

ABSENT: Tom Haberstein, Supervisor

VISITORS: Loren Nelson, Carol Kitchenmaster, Dennis Kitchenmaster, Tom Gryboski, Josh Riebe and Mike Hess.

Chairman Joanne Roy called this meeting to order at 7:30 p.m.

Lee S. moved to accept the agenda with an addition of the VanHecke Certified Survey Map to Line Item 5, Plan Commission. Second by Joanne. all ayes motion carried.

Motion made by Lee S. to approve the Minutes of the December 10, 2012 monthly Town Board Meeting.
Seconded by Joanne. all ayes motion carried.

Treasurer�s Report: Given by Virginia Nelson, and summarized in these minutes.

Checking Account Beginning Balance: $ 90,463.77
Receipts: $ 15,319.05
Total in Checking $ 105,782.82
Less Expenses: $ 46,243.44

Joanne questioned if some of the monies where deposited in January.
Virginia responded yes, through January 13th.

Lee S. moved to accept the Treasurer Report. Seconded by Joanne., all ayes motion carried.

Plan Commission:
REZONE, CONDITIONAL USE & CSM/PLAT PROPOSALS:
1. Rezone VanHecke Certified Survey Map on Jack Pine Camp Road.
Subdividing property as shown into two lots. Plan Commission recommends approval of the Certified Survey Map.

Motion made by Lee S. to approve the division of Van Hecke property as shown on the Certified Survey map. Second by Joanne. All ayes, motion carried.

2. Rezone for Schmechel property on East Chain Lake Rd. from Commercial to Residential.
Property owners went to Oconto County last month for the meeting, which was the wrong location. The Schmechels did not show to the Plan Commission meeting again. There is question if the County held the hearing for the property. Denise commented that a copy of hearing was given to the Plan Commission; the hearing was scheduled for December 27, 2012.

Lakewood Cross Country Ski Club Request to control traffic:
Request was received from Fred Axelrod to control traffic on Old 32, Sullivan Springs Road and Smyth Road for a Cross Country Ski Event to be held on February3, 2013.

Motion made by Lee S. to approve the traffic control. Second by Joanne. All ayes, motion carried.

Carol Kitchenmaster/ Mark Teuteberg, Assessors Plat lot line reviews:
Carol Kitchenmaster pettioned the board for a proposed Assessor Plat be done.

Mark Teuteberg, LIS Admin/County Surveyor Office was present to give description of the issues of the properties located on Highway 32 within the Northeast Quarter Section 31 Township 33 North, Range 16 East, Town of Lakewood. Mark presented a copy of a map of the area involved.
Property owners Scott and Cheryl Peterson, Veryle Kitchenmaster, David and Heather Gryboski, Carol Kitchenmaster, MMADKAT IV LLC c/o Jared VanLanen and Rovella Anderson are involved in the possible Assessors Plat to be made.
The issue has been going on for a couple of years, first brought to light when a survey was being made for Kitchenmaster. There was a discrepancy between adjacent land owners and parcel at hand. Through various surveys completed in the past there has been err as to where property lines and boundary lines are located, some of which overlap into or leave gaps along other property creating land division violations.
If the town pleases to do an Assessor Plat, a Public Hearing would need to be held, the land owners would need to be notified, and solicitation of bids for surveyors would be needed to complete the project. Public Hearing is held to get the town�s people involved to voice their opinion, the bids are opened at the hearing also. It is the Boards final decision if the project goes forward. The bid is awarded to the most desirable surveyor. The Town and Surveyor have a contract. The Town pays for it and it is assessed back to the land owners. It is assessed back to the land owners, assessed back based on a ratio and the value of land. To defray some of the cost the County will supply all the deeds and documents needed. The County has already run the section and knows the dimensions. There would recording fees, filing fees, submittal fees to the state.
Peter Liptack, Town Assessor was present and commented that all of this was new to him. He had not been contacted pertaining the issue. Comment was made that if the he were to make the decision to do an Assessor Plat the issues should be spelled out, these are the issues with these particular properties, and list the issues A, B, C, etc., so when the property owners come back to you, an informed decision can be made. If the property owners go to transfer a property, what is the issue from stopping them? Through the years there have been multiple sales in the specified area. What the issues if someone were to buy one of the properties now?
Mark commented that the title would not convey the correct property lines, it would not be clear. The deeds do not match the specified area.
Public Hearing could be held next month if the Board decides to move forward.


Dollar store was not in accordance with ordinances. The Assessor�s Plat would be clearer and fairer than one person footing the whole bill

Lee S. questioned why the discrepancies have not been found before?

Mark commented the County does not call land owners, they just map as close as can be done.

Peter commented it would be good to hold a Public Hearing in the interest of the community, land owners and future buyers. The Wheeler Lake area has similar encroachment issues, which makes it very hard to assess the property.

Mark commented that since he has been with the county there have been approximately eight to ten assessor plats completed.
Mark commented that he would work with the clerk to get letters and copies of the maps to individual property owners. The town can pick the surveyors and he could provide with a list of them.

Motion made by Lee S. to hold a Public Hearing on the possible Assessor Plat. Second by Joanne. All ayes, motion carried.

� Forest Service has a new contact. Caution Buoys should be placed in area at Wheeler Lake Boat Landing instead of no swimming
Lee S.:
� Wisconsin Towns Association Meeting in Wabeno at Indian Springs. Joanne and Lee will attend.
� Commented that the tires that are existing at the Recycle Center should be prorated because they were sitting there prior to the rate increase.
Peter:
� Needs to be compliant with data storage. A computer tech is needed to find out what is needed. Joanne commented it could be saved to excel and maybe there is a test site to see if an upload would work. Peter added the letter he received states a format is needed. Joanne would call the state to see if there is a place to submit an upload to see if it works.
Denise:

Pay Vouchers:
Motion was made by Joanne. to approve the vouchers. Seconded by Lee S.. All ayes motion carried.

Public Comments: None

Set date for next Regular Town Board Meeting (February 11, 2013) immediately following the Public Hearing.
Public Hearing will be at 7:00 p.m.
