REGULAR TOWN BOARD MEETING September 12, 2011 7:30 p.m. LAKEWOOD ADMINISTRATIVE OFFICE
This meeting was posted in the four usual places those being the Lakewood Town Hall, Lakewood Super Valu, Laona Bank and Lakewood Administrative Office.
PRESENT: Joanne Roy, Chairman, Lee Spletter, Supervisor. Tom Haberstein, Supervisor Denise Jackett, Clerk and Virginia Nelson, Treasurer.
VISITORS: Loren Nelson, Josh Riebe, Raoul Schottky, Don Jackson, Greg Weyers, Neale Block , David Pitterle, Bob Landwehr and Lonny Jackson. Chairman Joanne Roy called this meeting to order at 7:30 p.m.
Tom H. moved to accept the agenda. Second by Lee S., all ayes motion carried.
Motion made by Lee S., to approve the Minutes of the September 12, 2011 Regular Town Board Meeting. Second by Tom H., all ayes motion carried.

Lee S. moved to accept the Treasurer Report. Second by Tom H., all ayes motion carried.
Plan Commission: Lee S. Reported. REZONE, CONDITIONAL USE & CSM/PLAT PROPOSALS: a. Rezone application for Allen Mason property on North Road. Tabled until next month. b. Land division application for Mary Jane (Margaret) Roy property on North Road. c. Land division application for Leonard Roy property on North Road. Plan Commission recommends the approval of the land division Certified Survey Map for the Margaret Roy property and the Leonard Roy property on North Road. Lee S. moved to approve the land division for the Roy properties. Second by Tom H., Joanne recused herself due to conflict of interest. All ayes motion carried. d. Forrester Road/ Pitterle Certified Survey/Cul-de-sac requirement? Plan Commission has question needing to be answered by the County. Tabled until next meeting
Approval or Denial of Pavilion Labor Bids: Materials expense equals $22,050.33; less donation by Lakewood Hardware & Lumber of $1,105.00 leaves a balance of $20,945.00 Two bids were received. Beaber Construction $14,980.00 Stangel Construction $33,160.00 The Lakewood Fire Department raised approximately $6000.00 in donations and the Lakewood Fire Association will contribute $20,000.00 to the project. The town would have a balance of approximately $10,000.00 to cover.
Joanne moved to accept to bid from Beaber Construction in the amount of $14,980.00. Second by Lee S.. All ayes motion carried.

Lee S. made motion to have the town pay the remainder balance of the $10,000.00. Second by Tom H. . All ayes motion carried. Joanne commented the monies could come from either the Capitol Improvement Account or the Cemetery Improvement line that had not been used this year. Denise added there was $2000.00 donated by the Pepsi Cola Company through Super Valu that needs to be used for the park.
Seal Coating of Pavilion Blacktop: Quote from Burr�s Northwoods Seal coating & Asphalt Maintenance in the amount of $2,185.00 Tom H. made motion to have the seal coating completed by Burr�s. Second by Lee S.. All ayes motion carried.
Resolution for Adopting Employee Grievance Procedure (Act 43): Town must comply with Act 43 and set a Grievance Procedure Policy. A Hearing Officer must be selected and discussion was held on the selection of the officer. The officer cannot be an employee of the Town or Town Board. Hearing Officer should be someone with labor knowledge. The fees for the Hearing Officer are to be split between the employer and employee. Joanne recommended having the Stellpflug Law Office be the Hearing Officer with fees up to and not to exceed $800.00. Denise commented that the Wisconsin Towns Association recommended that the fees may change in two years. At which time the grievance procedure has to be updated.
Tom H. made motion to have the Stellpflug Law Office be the Hearing Officer with fees not to exceed $800.00. Second by Lee S.. All ayes motion carried.
Resolution for Employee Grievance Procedure was signed.
Approval or Denial of Aramark Contract: Another company was interested in submitting a bid. Tabled until next meeting.
Set Date for Budget Work Shop: Date set for Wednesday, October 19th, 2011at 2:00p.m.
Board, Clerk, Treasurer, Assessor Comments and Correspondence:
Joanne: � Received a call from Lakewood Outdoor Services pertaining to the Lakewood Ball Park. Ball field is in need of maintenance. Mikey Flynn was present and recommended that fertilizing, herbicides, seeding and sprinkler heads be installed. Tom H. commented that he had spoken with Ted Bartels and he also stated the ball park needs work. Mikey Flynn noted that the Trailhead was in need of maintenance also. Should start in fall and continue in spring. Trailhead building $453.63 Ball Park $1044.45
Tom H. made motion to have the annual maintenance completed at the properties. Second by Lee S.. All ayes motion carried. � Local Roads Improvement Program meeting will be held on Wednesday, September 28, 2011 at the Town of How Community Building, 6:30 p.m.
Tom H.: � Lakewood Shell has issue with water standing in the paved area near Assisted Living. Possibly put blacktop or install drain, the hole sinks every year. It was not done properly. Greg Weyers stated that Corrigan was to put a drain pipe down, in the ditch over to the storm sewer. It did not get done the way it was too. Josh will look at possible options.
� Commented on the tree removal on Brook Lane. It looks good and improved the visibility of the corner of North Road and Brook Lane. Garage workers did great job. Lee S. � The Town Board had approved a new furnace and air conditioning be installed at the Town Hall. Questioned if a new hot water heater should be installed. Joanne commented that Gem heating had called her. The existing one was about thirty years old and full of sediment in the bottom. Instead of having to vent it various ways when putting in the furnace the water heater was installed. It would be more efficient.
� Capital Improvement Committee has been formed. It consists of Terry Johnson (Chairman), Hank Lipinski and Marlynn Bartels. An organizational meeting has been held. Some information has been received from Denise. They will be going out to look at sites of town properties. Information should be available by the November Meeting.
� Lee met with the property owners on Wheeler Lake Boat Landing. They had discussed the issues that had been presented with parking on town property, where the property line is, parking the pontoon boat and other accessories on the one side of the dock verses the other side. The property owners were agreeable that they did not want to cause problems. They were informed of how the town property does extend down to their dock and that the line of trees is not their property line. The town should wait and see how the property owner handles the issues that pertain to the area.
� Attended a meeting of Nicolet Cross Country Ski Club. They are discussing the possibility of bringing back the Nicolet Ski Race. They want the town to be aware of the possibility and that it would be held the first weekend of February. There would be nothing on the town�s part except for snow to be put across Old 32, Sullivan Springs Road and Smyth Road for the skiers to cross. It has been done in the past and the snow would then be removed after the race. There would be no road closures, people directing traffic would allow traffic to flow through.
Denise: � McCaslin Lions Rental of August 5, 2011 thru August 8, 2011 (Craft Fair). Lions Organization did not complete the new contract (given to Pete Renteria) prior to the event. Should the Security deposit be kept in place of the rent they had not been paid? Per the Board, take out for the days they owe. � Complement from taxpayers for R & T Construction on the replacement of the steps at the Waubee Lake Public Access. It looks very nice and they are using them. � County Clerk break down of the estimated cost for the 2011 recall Elections held in Oconto County. A total of 5elections were held for Districts 2, 12 and 30. Total estimates $51,722.09. Town of Lakewood cost at $2772.93 excluding the cost of postage, ballots and programming of machines. � Oconto County Highway Commission Ordinance 1981-2011 revision. Speed limit on County W reduced from 55 miles per hour to 45 miles per hour. � Crime Stoppers of Oconto County, Inc. asking for support in this year�s budget. � Reminder of the class for the Oconto County Emergency Management on Thursday from1:00 to 4:00 in Oconto for the Board members attending. � E-mail from Ann Hogan (Six Town�s Board) to Bruce Mommaerts (Oconto County Economic Development) in support of Oconto County Marketing program. She stated that she could not include the Town of Lakewood as a supporter because they were not present at the meeting. The Town of Lakewood was not represented due to priority issues. � Hidden Bear ATV Club minutes. � Oconto County office of Planning, Zoning & Solid Waste: a. Letter pertaining to a satellite dish that was dropped off at the Lakewood Drop off Center by a resident and had been seen at the Lakewood Garage site. The owner of the item matter had contacted the site attendant, Lonny Jackson, and he in return referred to the County because he was unsure if the town could remove items designated for recycling. Denise felt that if the town is able to use something from the dump they should be able to remove it, just as other people are taking things out of there also. She sees it all the time. b. Flood Insurance Workshop to be held at Oconto Falls Municipal Building, Council Chambers, 500 N. Chestnut Avenue on September 20, 201, 2:00 p.m. � Letter from Michael Rzepka, Animal Control Officer, noting he would be on vacation September 11 thru September 21all calls will be referred to the respective towns. � Wisconsin Department of Transportation WISLR training and Road Maps notice. � Northern Health Center balance Sheet. � Wisconsin Department of Natural Resources a. Notice of payment in the amount of $748.01 for Forest Crop and Managed Forest. b. Notice of private woodlands to be enrolled under Managed Forest Law. Wisconsin Department of Administration notice of population for the Town of Lakewood at 218. � Wisconsin Department of Revenue: a. Equalized Value Report, Town of Lakewood 2011 Equalized value at $230,898,600, down $10,173 from 2010. b. Notice of Electronic Assessment Data Requirements to be implemented by 2013 assessment year. 1. Assessors will follow the Uniform Standards of Professional Appraisal Practice (USPAP). 2. A municipality�s assessment data must be stored on and maintained e electronically. � Alliance for Regulatory Coordination letter and award of Certificate of Commendation for the town�s efforts to promote public safety in our constructed environment and providing vital building and fire safety guidance and regulation to our citizens and visitors.
Pay Vouchers:
Motion was made by Tom H., to approve the vouchers, seconded by Lee S.. All ayes motion carried.
Public Comment: Dave Pitterle: Inquired as to why he was not let know about the issue of the Forrester Road/ Cul-de-sac being on the Plan Commission agenda so he could give his comments on it. � The commission has questions for the County, Why the county is requesting the dedication of the property and the location as to where it should be. � There has been letters of rejection from property owners near the possible location of the cul-de-sac. � A copy of the letter was sent to the town and a duplicate copy of the letter was given to the Plan Commission because the town board acts on the recommendation of the commission. It was thought that a copy of the same letter would have been sent to Mr. Pitterle. � The lot is only 207 feet, 70 feet dedicated to the Cul-de-sac is one-third of the property, thought to be a little ridiculous. � Tabled on Plan Commission Meeting until next month. Loren Nelson: Representing Hidden Bear ATV Club. � The Club has received an increase in the amount people asking why the Town of Lakewood Roads can�t be opened like Townsends? Is there a way it can be approached? � Originally set up petitions for equality between land owners. � More negativity response and speed limit issues. � Comments are more on closed roads because ATV�s are speeding to get down roads that are not open so they don�t get caught. � Believed if the roads were opened there would be fewer problems. � Suggested a public hearing in the spring to be held for the property owners to make a decision on if they would like them all open or open one at a time. � County roads are completely different. The town has no jurisdiction over County Roads. � Suggested a letter with a return card be sent to the property owners for them to decide what to do. � With the Town of Lakewood having the Trailhead doesn�t look good to be the most restrictive for ATV�s. � Signing the new trail from Thelen Road to County T and Highway 64 this week. � Promote Tourism with the use of trails. Don Jackson: Motorized Disability Act passed and can run on State and County land. Virginia Nelson: Suggested enclosing a Recycle Center Use Card in the mailing. Lonny stated that people from Wabeno are using the Recycle Center and he doesn�t know how to stop it. Policy should be written for use of the Center. Denise: Inquired if the town could hold a Hazardous Waste pick up in the Town? Lonny made mention that there was a Clean Sweep program through the county at one time that was held if there were enough monies to collect.
Tom H.: Old computers, typewriters will be collected at the school on September 17, 2011. Lonny stated that good will takes them at the Recycle Center and the County will take them for a charge. Greg Weyers: The County says florescent tubes can be taken to the Recycle Center to get rid of the mercury. Lonny stated they can be brought to the center for a price of $.50 each. The issue is they only pick them up once a year and they end up broke before they pick them up.
